On 10.02.2015, the Hon'ble Supreme Court has passed the
following orders in the matter :-
UPON hearing the counsel
the Court made the following
O R D E R
We have perused the
preliminary report of the learned Amicus Curiae. At the outset, we make it
clear that the report that the learned Amicus Curiae is required to submit to
the Court is a compilation of the relevant facts in seriatum indicating, inter
alia, the claims and counter-claims of the various parties before the Court and
the orders passed with regard to the same. The learned Amicus Curiae is not
required to give any hearing to any of the contesting parties or to take any
material or application(s)/document(s) from any of such parties. The report to
be submitted by the learned Amicus Curiae will be solely on the basis of the
materials already on record. The above clarification has become necessary in
view of certain submissions made before us.
Having considered the
preliminary report of the learned Amicus Curiae, we appoint Ms. Anitha Shenoy,
Advocate-on-Record as the co-Amicus Curiae who will inspect the records along
with a team of junior advocates of her choice. Thereafter, in consultation with
Shri Raju Ramachandran, learned Amicus Curiae, the requisite report will be
submitted within a period of four weeks from today.
It is stated at the Bar
that Writ petition (Civil) Nos.1064/2014, 2/2015, 3/2015 and 6/2015 are similar
to the present matters and may be heard along with the present matters. It is
ordered accordingly.
